Terms of Use

These terms govern your use of the site, your dealings with providers you find on the site, and any submissions you make to it. They’re an agreement between you and BizMonda LLC, which owns and operates www.bizmonda.com (“BizMonda”). By using the site you accept these terms. If you don’t accept them, stop using the site.

What BizMonda is

BizMonda is a directory. We list B2B service firms and business software, we verify the businesses we list, we publish research and comparisons, and we forward buyer inquiries to providers who may be able to help.

We are not involved in any agreements you enter into with providers. We do not provide any of the services listed on the site, we do not oversee providers, we do not hold your funds, and we are not your agent or broker. You and the provider you deal with are solely responsible for your contracts with each other.

BizMonda provides general information, not legal, accounting, tax, financial, or professional advice. If you need advice about a decision you have to make, consult a qualified professional.

Who can use the site

You must be at least 18 years old and able to enter into a binding contract. If you submit a match request or use the site on behalf of a company, you represent that you have authority to bind that company to these terms. The word “you” refers to both you and that company.

What verification means and what it doesn’t

Our verification standards are laid out on our verification process page. But here’s the short version. We check businesses against public records, licensing databases, corporate filings, and any documentation providers give us. If the evidence supports the claim a badge represents, we grant that badge. A badge means we checked one thing and found it to be true at the time we checked.

Verification comes at two levels, and they differ by method. Verified is the floor for being listed at all: a researcher checks public records, licensing boards and corporate filings by hand. Verified Plus keeps that manual review and adds an automated Know Your Business screen covering company registry and incorporation data, beneficial ownership, sanctions and watchlist databases, and adverse media. Providers with Verified Plus also receive a full profile. The full method is set out on our verification process page, and the criteria behind every badge on our badge guide.

Businesses apply for Verified Plus and pay a flat fee. That fee pays for the checks being run, not for passing them. We deny the badge where the evidence doesn’t hold up, and the fee is not refunded; we give applicants an early indication of the likely outcome so that nobody spends it on a check they will fail. A provider without Verified Plus has not failed anything — it simply hasn’t applied. A business we deny may correct the problem and apply again. Some providers carry badges having paid us nothing, because our editorial team selected them.

Verification is not an endorsement, recommendation, or guarantee of quality. It’s not a promise about how a provider will treat you. When we verify a business, we don’t audit financial statements, inspect work product, test software, or validate pricing, availability, or outcomes. Verification is about who a business is, not how a business performs.

Information gets stale. Companies get acquired, licenses lapse, teams leave, and claims go out of date. We re-verify annually, which means information on the site can be up to a year old. The first three years of re-verification are included in the initial Verified Plus fee; after that a re-verification fee applies. Do your own diligence before you hire anyone or buy anything.

Ratings, picks, and rankings

The BizMonda Rating is our rating based on public reputation signals. BizMonda Pick is our editorial opinion. Both are opinions. Under the law, opinion is protected speech. It is not a statement of fact about a provider.

Some placements on the site are paid. Where a listing, position, or link is sponsored or featured in exchange for payment, we label it, and our Advertiser Disclosure explains the arrangements we have with providers in full. Verification badges cannot be purchased. Applying for Verified Plus buys the assessment, never its outcome, and we deny badges the evidence does not support.

Match requests

By submitting a match request you allow us to share it with providers and partner networks who will then contact you. If you complete a match request you agree they can contact you by phone, text, and email, including through automated dialing systems. You can withdraw consent at any time. Please see our Privacy Policy for details on exactly what we share, with whom, and how to withdraw your consent.

Match requests must contain accurate information. Submitting requests you do not intend to follow up on, submitting on someone else’s behalf without permission, or submitting fabricated requests wastes providers’ time and money and violates these terms.

Provider listings and submissions

If you submit a provider listing, claim, review, correction, verification documents, or any other content to BizMonda, you represent that you have the right to submit that content, that it is accurate, and that it does not infringe the rights of any person or entity. You give BizMonda LLC a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, display, reproduce, adapt, distribute and otherwise use that content on BizMonda and in our marketing and research.

We reserve the right to reject, edit, or remove any submission, and to refuse to list a business or remove a badge in our sole discretion. Being listed is not a right, and removal is not a penalty we owe you process for.

If you claim a listing, you are responsible for the accuracy of that claim. Tell us when something material changes, such as a license lapsing, a change of ownership, or a change in the service area you claim to cover.

What you may not do

• Scrape, crawl, harvest, or bulk-copy the directory or any part of it, whether by script, extension, or manual effort, or use our content to build or train a competing directory, dataset, or model.
• Resell or redistribute our listings or ratings.
• Misrepresent your relationship with a listed business.
• Post anything false, defamatory, harassing, or unlawful, or upload malware.
• Probe, scan, or test the security of the site, or try to get into any part of it you were not given access to.
• Interfere with the site’s operation or place unreasonable load on it.
• Use the site to send spam or to collect contact details for spam.
• Use the site in a way that breaks any law that applies to you.

Intellectual property

BizMonda LLC owns the site and the copyright, trademark, and other intellectual property rights in the design, content, and functionality of the site, including the BizMonda name and logo, badge designs, ratings, research, text, category taxonomy, graphics, code, and the compilation of all that. Permission is granted to view and print pages for your own business use. Any other use requires our permission.

Providers own their names and logos. We display them for identification purposes only.

Third-party sites

BizMonda links to provider websites, partner networks, and other third parties. We have no control over those sites, we’re not responsible for their contents, their products, or how they handle your information, and linking to a site is not an endorsement. Their terms and policies apply when you leave BizMonda.

Disclaimer of warranties

BizMonda is provided “as is” and “as available”. BizMonda LLC excludes, to the fullest extent permitted by law, all warranties, whether express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties created by any course of dealing or usage of trade.

We make no warranties that the site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that it is free of viruses or other harmful components, or that information on the site is accurate, complete, or up to date. We make no warranties about the quality, legality, safety, or suitability of any provider, software, or service listed on the site, or anything a provider may tell you or do for you.

Limitation of liability

To the fullest extent permitted by law, BizMonda LLC and its members, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, business, data, or goodwill arising out of or in connection with your use of the site, any listings on the site, or your dealings with any provider, regardless of the theory of liability and whether we were advised of the possibility of such damages. This includes, but is not limited to, claims in contract, tort (including negligence), strict liability, or any other theory arising under any applicable law or otherwise.

In no event will BizMonda LLC’s total liability to you for all claims relating to the site exceed the greater of the amount you paid us in the twelve months preceding the claim, or $100 US.

Some jurisdictions don’t allow limitations on certain warranties or the exclusion or limitation of certain damages. If that’s the case, the limitations in this section apply to the fullest extent permitted by law. Nothing in this section limits liability for fraud, personal injury caused by negligence, or any other type of liability that cannot lawfully be limited.

Indemnity

You will defend, indemnify, and hold BizMonda LLC and its members, officers, employees, and agents harmless from any claim, liability, damage, judgment, award, or expense (including attorneys’ fees) incurred by reason of your use of the site, anything you submit to the site, your breach of these terms, or your violation of any law or anyone’s rights.

Disputes about providers

If something goes wrong with a provider you found on BizMonda, your recourse is against that provider. We’re not a party to your agreement with a provider. We don’t mediate disputes and we can’t guarantee a result. But go ahead and let us know anyway at legal@bizmonda.com. If a provider consistently receives complaints from buyers, we may pull that provider’s listing or badge.

Suspension and termination

We may suspend or terminate your access to the site at any time, with or without notice, if we believe you’ve violated these terms or if we are retiring the site or changing its functionality. Sections that should survive termination, like intellectual property, disclaimers, liability limitations, indemnity, and governing law, will survive termination.

Governing law and where disputes are heard

These terms will be governed by and construed in accordance with the laws of the State of New York, excluding its conflicts of laws provisions. All claims arising out of or relating to these terms or the site will be heard exclusively in the state or federal courts located in New York County, New York. You agree to submit to personal jurisdiction in those courts and waive any objection to venue or jurisdiction there.

Claims must be brought within one year of when they arise, or they’re gone forever.

Changes to these terms

We may revise these terms from time to time. The date at the top of the terms tells you when they last changed. Material changes will be posted on the site before they take effect. Continuing to use the site after that means you accept the revised terms.

The rest

If a court decides that any provision of these terms is unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable and the rest of these terms will remain in force. Our failure to enforce any provision is not a waiver of it. You can’t assign these terms. We can assign these terms in connection with a merger, acquisition, or sale of assets.

These terms and conditions, along with our Privacy Policy and Advertiser Disclosure, constitute the entire agreement between you and BizMonda LLC regarding the site.
